If you do not agree to all of these Terms, you must not access or use the Service. We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
Insight Gaming develops and distributes browser extensions and related digital tools designed to enhance the user experience on supported third-party platforms. Our products include, but are not limited to, Stake Tracker, Stake Analyzer, and Stake Engine. These tools provide data tracking, analytics, visualization, and automated betting features. The Service is provided on a subscription basis, and access to certain features requires an active paid subscription.
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
To access certain features of the Service, you must create an account by authenticating through Discord OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms. Each account is personal and non-transferable.
Certain features of the Service require a paid subscription. All payments are processed through third-party cryptocurrency payment processors. Subscription fees are non-refundable except as required by applicable law. Subscriptions grant access for the specified duration. We reserve the right to change subscription pricing at any time; existing subscribers will be notified before any price changes affect their next billing cycle. Failure to renew a subscription will result in the immediate loss of access to premium features.
You agree to use the Service in compliance with all applicable laws and regulations. You may not: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems; (c) distribute malware, spam, or harmful content through the Service; (d) reverse engineer, decompile, disassemble, or create derivative works of any part of the Service or our extensions; (e) share, redistribute, resell, or sublicense access to the Service or any extension; (f) use automated tools to scrape, mine, or extract data from the Service beyond its intended use; (g) interfere with or disrupt the integrity or performance of the Service.
All content, features, functionality, software, designs, trademarks, logos, and the compilation thereof associated with the Service are the exclusive property of Insight Gaming and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted, whether express or implied.
Our browser extensions are provided for personal, non-commercial use only. Each subscription license is valid for a single user account. Sharing, redistributing, or reselling access to the extensions is strictly prohibited and constitutes grounds for immediate termination of your account without refund. The extensions interact with third-party websites, and we are not responsible for any changes made by those third parties that may affect the functionality of our extensions. We do not guarantee uninterrupted or error-free operation of the extensions.
Insight Gaming provides analytical and automation tools only. We do not operate, promote, or endorse any gambling platform. The Service does not constitute gambling advice, financial advice, or a guarantee of profit. You acknowledge that any use of our tools in connection with gambling activities is done entirely at your own risk and discretion. You are solely responsible for complying with all gambling laws and regulations applicable in your jurisdiction. Insight Gaming shall not be held liable for any financial losses incurred through the use of the Service.
We collect and process personal data necessary to provide the Service, including Discord account information, usage analytics, and payment-related data. All bet data and session information is processed and stored locally in your browser; no bet data is transmitted to our servers. We do not sell your personal information to third parties. All data is stored securely and handled in accordance with applicable data protection regulations. By using the Service, you consent to such collection and processing.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
IN NO EVENT SHALL INSIGHT GAMING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
You agree to indemnify, defend, and hold harmless Insight Gaming and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any rights of a third party.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration authority. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
