By accessing or using the Insight Gaming website (insightgaming.us) and any associated browser extensions, services, or products (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
Insight Gaming provides browser extensions and related tools designed to enhance the user experience on supported platforms. Our products include but are not limited to Stake Tracker and Stake Analyzer. These tools provide data tracking, analytics, and visualization features. The Service is provided on a subscription basis, and access to certain features requires an active paid subscription.
To access certain features of the Service, you must create an account by authenticating through Discord. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms.
Certain features of the Service require a paid subscription. All payments are processed through cryptocurrency payment processors. Subscription fees are non-refundable except as required by applicable law. Subscriptions are billed on a recurring basis (monthly), and you are responsible for ensuring timely renewal. We reserve the right to change subscription pricing at any time, with notice provided to existing subscribers before the next billing cycle.
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. You may not attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service. You may not use the Service to distribute malware, spam, or any other harmful content. You may not reverse engineer, decompile, or disassemble any part of the Service or our browser extensions.
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of Insight Gaming and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or in any way exploit any of the materials or content on the Service without our express written permission.
Our browser extensions are provided for personal, non-commercial use only. Each subscription license is valid for a single user account. Sharing, redistributing, or reselling access to the extensions is strictly prohibited. The extensions interact with third-party websites, and we are not responsible for any changes made by those third parties that may affect the functionality of our extensions. We do not guarantee uninterrupted or error-free operation of the extensions.
We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to such collection and processing. We collect information necessary to provide the Service, including Discord account information, usage analytics, and payment-related data. We do not sell your personal information to third parties. All data is stored securely and handled in accordance with applicable data protection regulations.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
IN NO EVENT SHALL INSIGHT GAMING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration authority. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
